My Personal Bankruptcy Practice
When you contact me to discuss your options under the bankruptcy laws, I will first determine whether bankruptcy is the best solution for you. A bankruptcy filing can limit your options for a period of time, so you want to be certain that you considered all your options before filing.
If we decide that you should move forward with a bankruptcy petition, I will first conduct a means test to determine whether you qualify to discharge certain debts under Chapter 7 or whether you must reorganize or restructure your debt under Chapter 13. If you qualify to permanently eliminate debt under Chapter 7, I will make certain before you file that you understand which debts can be discharged (obligations such as student loan payments, child support arrearages and some tax obligations cannot be wiped out in bankruptcy). I will also ensure that all exempt assets, such as principal residence or vehicle, are excluded from the bankruptcy sale.
If you fail to qualify under Chapter 7 or you prefer to repay your creditors, I will handle all the necessary matters to help you reorganize your debt under Chapter 13. I will prepare and file all documents with the bankruptcy court and will represent you in hearings or meetings with creditors, the bankruptcy trustee or the bankruptcy court. I will help you prepare a plan of reorganization and will review any proposed repayment plans from creditors to make certain they are within your means. If you make agreements in bankruptcy, but fail to live up to them, you can lose the protection of the automatic stay, which prevents creditors from contacting you to collect the debt.
